NASSCOM's claim that only "small Indian companies" abuse H-1b visa is absurd

Last month U.S. Senators Durbin and Grassley wrote a letter to nine of the top Indian outsourcers regarding their use of H-1b, such as their wages, age of workers, number of U.S. citizens on staff, and their efforts to recruit Americans. To our knowledge none of the receipients have responded to the questions posed in that letter.

Instead the National Association of Software and Service Companies (NASSCOM) issued a statement that "there is little evidence of such fraud, or that restricting the number of H-1 B visas . . . will have any effect on visa fraud."

NASSCOM is being less than honest to the U.S. Senate - they have ignored the questions and raised the Red Herring of "fraud." The NASSCOM Executive Council is a "who's who" of Indian outsourcing firms, comprised of leaders of I-flex, Infosys, Wipro, HCL, and Mr. N Chandrasekaran, Executive Vice President of Tata Consultancy Services (TCS)

TCS is the number one user of combined H-1b and L-1 visas, with nearly 8000 applications in FY 2006.

We have already reported that TCS has boasted that it pays its H-1b workers 25% below market wages, and this this underpayment was its competitive advantage against American firms and U.S. workers.

While about half of TCS business is in the U.S., only about 1000 of their 90,000 employees are Americans. (Meanwhile TCS is planning to hire 5000 workers in Mexico, to assist with Perot's "giant sucking sound" of jobs.)

We also know that the thousands of TCS employees on L-1 visas can work in the U.S. for up to a year while still getting paid their foreign wage - $20,000 per year or less. These Mexicans that TCS is hiring will provide them an additional source of foreign workers that TCS can rotate into U.S. jobs and continue to pay them third-world wages, without the expense of international air fare.

Senators Durbin and Grassley have compiled a 354 page list of L-1 visa users. TCS is on top. They are asking the top users about their usage. We expect another Red Herring response from NASSCOM about "no fraud," avoiding whether they are displacing U.S. consulting firms that pay American wages by bringing in thousands of average skilled staff programmers on L-1 while paying them third world wages.

Congress: How is it not unfair competition to allow consulting firms to pay third world wages at U.S. jobs sites by rotating in workers from foreign sites? Might this be creating an incentive to NOT hire U.S. workers for U.S. jobs?

A large user of L-1 visa is Intel. During the same period that Intel in Folsom, California was laying of its American IT workers, I heard from multiple Indians on L-1 at Intel in Folsom that they and many other L-1 workers were not brought in for their skills. Instead they were new hires in India being brought to the U.S. for training, then would return to India to ramp up Intel operations there. U.S. training may be necessary since Intel blames the Bangalore division for botching the Whitefield Xeon processor project a few years ago.

Meanwhile the stress of being forced to lay off highly skilled Americans led to the suicide of a top manager at Intel Folsom in 2003. As Intel brings in foreign workers, they do not even attend career day at nearby CSU Sacramento.

While under the “spirit of the law” TCS is a bodyshop, and thus all of its employees “provide labor for hire for unaffiliated employers," it appears that under the letter of the law TCS can continue to second-source L-1 workers by a) assuring that the L-1 reports to a TCS employee, and b) assuring that the TCS employee is providing a service related to a contract that TCS holds with the client:

L-1 Visa Reform Act of 2004, signed into law December 8, 2004

SEC. 412. NONIMMIGRANT L-1 VISA CATEGORY.(a) IN GENERAL- Section 214(c)(2) of the Immigration and Nationality Act (8 U.S.C. 1184(c)(2)) is amended by adding at the end the following:

(F) An alien who will serve in a capacity involving specialized knowledge with respect to an employer for purposes of section 101(a)(15)(L) and will be stationed primarily at the worksite of an employer other than the petitioning employer or its affiliate, subsidiary, or parent shall not be eligible for classification under section 101(a)(15)(L) if—

(i) the alien will be controlled and supervised principally by such unaffiliated employer; or

(ii) the placement of the alien at the worksite of the unaffiliated employer is essentially an arrangement to provide labor for hire for the unaffiliated employer, rather than a placement in connection with the provision of a product or service for which specialized knowledge specific to the petitioning employer is necessary.

Can you show statistics that show a percentage of good H-1b employers that follow the laws vs. bad H-1b employers that abuse the laws?

I don't believe tech giants like Microsoft and Google are bad H-1b employers because they only want to hire the best (young) candidates regardless of their race, nationality, and sex.

You want statistics? Take a look at how the P.E.R.M. process works and watch what corps who hire law firms like Cohen and Rigsby do. The do everything possible to disqualify a qualified and interested American worker. Up to know, we all have been saying that the "skills-shortage" screaming is one big lie to obtain cheap (20-35% less than American counterpart) indentured (must stay 6-7 years so they can get green card -- if the leave to another employer, wait period starts all over again) servants. Fortunately, the truth has been exposed by this famous YouTube video -- which represents the RULE, not the exception (NASCOMM is now lying and saying it's the truth bu thank goodness Sen. Grassley and Rep. Lamar Smith are investigating this and will expose it ALL):

you have lost your own batwing argument: bad employers are exactly those like Microsoft and Google, who discriminate against age/nationality and those people they discriminate against are called Americans. both companies operate under the "greed is good" principle and it shows in their corporate cultures. they are not threatened by kids out of college who they pay less to crank out their "hot" products that mostly end up in the can (you know all about that). They are threatened by older and experienced
professionals who can easily do the work of 2-3 of those H-1b employees and everybody knows it.

Microsoft is paying 80-100k for an entry level H-1b worker. Don't tell me those people are underpaid in Seattle. Remember, that's just the base salary before all the benefits (e.g. full health insurance) and 20% bonus.

Again, people who can't compete hate any competitiors (whether they're American or foreign), period.

If you want to express your opinion about H1B visa, then you need to do your homework and understand how it works...

When you talk about P.E.R.M process, you are talking about immigration process that kicks in after an H1B employee starts working for the firm...So, do not mix H1B employment and Green Card PERM processing if you do not know the difference...

Microsoft and Google are exceptions and they may require skilled persons and some skills may not be available and they are paying well. But many companies like TCS, WIPRO are paying much below Market pay. H1B most H1b are used for normal average IT skills. Only 20 to 30% of H1b are bright and best people and more than 70% are average IT jobs and that can be done by American workers. Good rules and regulations are needed for recruitment of H1b persons. H1b pay must be much more than US citizens
so that they won't depress wages

My question to him is, where are the American workers? Most of the American workers are riding their high horses and dont want to step down from it saying, they wouldn't work on projects that pay average billing rate...To compete in a global economy, you should be cost-effective...A simple analogy to you..Walmart is opening up their stores in India and they can sell anything for much less than the normal indian market rate...Should that mean, India shouldn't allow walmart to setup stores? or should that mean, walmart's indian competitors should look at ways on how they can compete? If you know the answer, you will know the answer to your predicament...my 2 cents..

If Microsoft and Google really bring these workers for their skills, lets give them green card from start and make mainimum wage 100000. At least Oracle has said, they oppose it.

With current system, these workers are essentially bonded labor. They can't complain about long hours or switch job. Companies not just save on salary but also on depressed wage for all worker, turnover cost etc.

Obviously you are not in any tech field nor do you understand the immense amount of time skilled IT workers must invest in their careers at the expense of their families. We can not simply leave our jobs for the day - Many of us are on call 24/7. Our employers pay for internet access from home and give us laptops - That's not for personal use or enjoyment mind you, that's so we can continue working while the world has gone to sleep.

While this pace is enjoyable after college, once a family is in the picture, our spouses understanding wears thin when we have to be 'Johnny on the spot' night after night to fend off competitors who are 'forced' to work more or leave the country, oh and they have to do it for less. Not exactly a level playing field, would you agree?

So who cares? Even you should.

You would easily agree this country is going to require more (not less) skilled IT workers in the future.

Why then are we finding less American students entering degree fields in computer science or management information systems?

Here's the sales pitch, let me know if you would buy it - "Great career field where you get a salary, no overtime pay. Expectations are that you will routinely put in 45-60 hours per week (even though your status report need not show anything more than 40) and continue your education, often times in your personal time, to stay knowledgeable in your field. Should you decide to have a family, note that the job requirements won't change and that you can expect healthy competition from an endless supply of educated fresh eager youths from 3rd world countries who want your job at a fraction of what you get paid. Note, they will either return back to their countries and their families after they have had a good go of it here, or will have children here and thank god (or Alla) every day that they don't have to ride on the top of a bus with chickens to work. If they continue to work hard they will eventually get sponsored for their green card. More hard work and they can get their citizenship and put an oar in the water as Americans, just to find another one just like they were champing at the bit for their job."

I guess it's easy to see why less Americans are entering this field and why far more have left this field for any other field that offers less demands on their personal time.

At the end of the day, this is nothing new. I'm sure southern cotton pickers felt the same way before indentured help was brought in, or rail road workers in the Pacific Northwest when immigrants were brought in or mine workers, steal laborers or any other profession that relied upon cheap foreign labor... The difference this time is that these are not unskilled positions. This is the life blood of our countries future economy - Technology.

As our countries technological advantage slips more to foreigners, many of whom are islamic, at what point will we look back and say that was a foolish decision?

There was a mess created by department of state and USCIS. Actually they made priority date of all the Green card aspirants made current on july Visa Bulltein. That means anyone who had labor certification could apply for final stage of GC. For 2007 around 40k(total 140k visa available) visa was remaining with country quota
of 7%. They should not have made everything current. They should have moved Priority date gradually.
But by mistake they made current and that could create flooding of Green card applications(200k to 500k for just 40k visa numbers. But on previous day USCIS and DOS realized the mistake and corrected (which is unprecedanted). Now most of the immigrant groups are planning lawsuit. Actually one person does not need to get green card. If he files GC(third stage, I 485) that is enough and he can enjoy all the benefits of GC though
he does not receive GC. For getting green card Visa number should be available.

Let's look at all the claims that these people have made.

1. "Suicide of a top manager at Intel because he was told to lay-off people".

If you follow the link you will see it says NOTHING about layoffs. It talks of
work stress at Intel. So turns out this like everything else from Programmer's Guild is not true.

2. Intel did not attend career day at CSU.

I looked up the ranking of CSU and I just found it to be a 3rd
tier universisty. No wonder Intel didn't go there for recruitement. Did Kim Berry tell us about the universities where Intel did go for hiring ? No, because that will puncture his
entire argument. They do go to the top schools and hire smart people.

Again if you follow the link the actual title of the article is
"Intel India earns chance at Xeon redemption". And if you read
the article you will no more of the details. Intel has wound up
hundreds of projects in it's history. So here we go again another lie.

but just for cooking.

Dear Mr. Kim Berry,

It's obvious that none of your arguments are valid or bear any strength in them. A car repair shop is not going to hire someone who doesn't know how fix cars no matter how cheap he is. No company, let alone the top, will hire people who are
incompetent, because that will threaten the very existence of the same companies.

I don't know why you bay for the blood of the H-1b workers and by doing so you are only forcing American Companies to go and open up shops in India and then what you say has already happened will
really happen. If H-1b give companies a bonded labor advantage then why don't you ask that H-1b workers be given the same work status as American workers allowing them freedom to change
employers etc. But no you are not for that either because that will again blow up your argument.

It is obvious from all this that you are only a person who hates India and Indians. But you know what you can't stop the sun from rising. You can cover it's light from falling on your face with your palm and claim that the sun is not bringing you light and there's darkness all around but that darkness is in your mind only. And rise it
will, the sun, over India, America and all other places that believe the equality of all HUMAN BEINGS, you can open your eyes and basque in it's glory or you can cover your eyes and tell the whole world there is darkness everywhere. The choice is yours.

Sir..Ofcourse, I have been in the thick of Tech field for the last 10 odd years and do invest my personal time towards the future growth of my career...

I do not understand why is it so difficult for you to invest your personal time on something that is going to BENEFIT only you...I mean, do you expect to earn 140K USD just by learning something on a 4 year grad school and using those skills alone for the rest of your 40 odd years career?

If that is what you are looking at then, honestly Sir, I dont think you belong in IT field...You should be looking at a different career like Admin Assistant or Office clerk where you can do the same job with the same SKILLS for 40 ODD years...

If a company pays you 100K, which is like 90 or 95% more than any average american's earnings, and all they expect you is to update your skillset, is that asking too much? I just couldn't understand your thought process...May be, I am missing something...

Would you mind telling us, what do you consider as "DECENT WAGES" ? Am sure, whatever you consider as "DECENT WAGES" is more than 90%-95% of average US household income! Well yeah, you are an IT professional and you think you deserve to earn your "DECENT WAGE" to support your "DECENT LIVING"...

And yeah, US students would get interested in IT only when 'Joe Francis' creates a series like, 'GIRLS GONE WILD AT CALTECH' or 'SPRING BREAK AT MIT'...else, US students would never get interested in any academic field that is challenging to them...

Average household income in the US is around 45k. You wonder how some keep complaining about their wages despite they obviously get more than 45k. It's about greed, ding!

There you go again the attacks without feasible solutions on the H1-B program. It has been proven through independent studies that the prevailing wage is not a reliable measure of what H1-B workers are truly paid. In a free market economy and with visa portability in place, it is unrealistic to claim that an underpaid worker with skills in demand will be stuck at a employer who pays low wages as they can similarly exercise their freedom of choice as to whom they should work for. The writing is on the wall and Canadians are now rejoicing. Companies will always go where the talent is, keep it from coming to the US and the jobs will ultimately end up outside the US:

Hardly any "Small Companies" in that list, hell! there are no small companies in that list!

Innovation in India, now, mostly exists in smaller companies and they are suffering due to abuse of H-1b visas more than American highly skilled yet unemployed.

You use "old" and "unqualified" as if they are synonymous.

SO, that means every single one of you, no matter how educated, skilled, intelligent and productive, automatically becomes "unqualified" on your 35th birthday?

Some people are just starting their careers when they hit their lates 30s (ex. moms like me who are finished raising children). I'm at 60K now and plan to get to about 90K before I hit age 50.

At least I had the sense to stay out of the IT field! Although no one now is safe from having job outsourced.

Companies which violate immigration laws need to be exposed. HTC Global Services is a company based in Troy, Michigan with offices around the world.

In India, it has offices in Tambaram, a suburb of Chennai.

This company has been found to violate US immigration laws. The following instances along with supporting evidence cautions employers and non-immigrant workers.

1. HTC Global Services has been found to violate the US Immigration laws on "6/8/2000" specifically "Failure to comply with subpart H or I (failed to obtain PW documentation)".
